We Defend Credit Card Lawsuits

Who among us has not been affected by the downturn in this economy. Many families are living under a crushing credit card debt, and making minimum payments does not make the balances go away. Sometimes in frustration people stop making payment.

Initially the credit card company calls you two to three times a day and cajoles you to make small payments, etc. etc. Then the debt is either sold off to a collector for pennies on the dollar [usually called a Charge-Off on your credit report] or given to a collection agency to collect on the debt. Collection agents work on commission. If they cannot get money from you, they do not get paid. Collection Agents will use every trick in the world to get some money from you such as appealing to your sense of right and wrong, yelling at you, threatening you with legal consequences, abusing you, calling you 10 times a day, calling you at work, etc. All of this is illegal and violates the Fair Debt Collections Practices Act, and You can sue them and get damages. Once the collector is not successful, it is possible that they may hand the matter over to a local attorney who will sue you in County or Circuit Court. You will be served with a Summons and Lawsuit, and You have 20 days to answer that lawsuit. If you fail to file a response, a default Judgment will be entered against You. A Judgment gives the creditor to garnish your wages, levy on your personal property or vehicles, attach your bank accounts, etc. You must do whatever it takes to avoid a Judgment.
